What establishes residency for a short-term rental like Airbnb if someone doesn’t leave?
How to Legally Get Your Unpaid Rent in 2025
For a short-term rental, like an Airbnb, what establishes residency? There are rumors on the Internet that receiving mail or Amazon packages establishes this, but I don't agree. I'm in Ohio, but we're no trendsetters in anything. So I think really, you know, yeah, short-term, what if somebody doesn't leave?

In general, in California, once they get in there, even if they're a short-term renter, if they don't move, you're not going to be able to go change the locks and put them on the street and put their stuff out. You're going to have to avail yourself of the unlawful detainer process. So they have essentially tenant rights from the moment they step in.
