Certainly you could. You could try. But what's going to happen is if you go through a process of, you know, it's technically a lease breach, then the judge, if it gets to court, is basically going to try to give the tenant a chance to fix the problem. So they might just say, well, yeah, I'm going to stop smoking. and then they go back to smoking. The other thing that might happen is that they're going to want to see evidence of that person smoking, and that might be difficult to obtain. You can get eyewitnesses, start collecting statements from neighbors. That might help. If you're trying to build a case to take it to court, you definitely want to start talking to an attorney now. It's not impossible, but it is very very difficult.
