Does the lease apply once they become a month-to-month tenant? This was in reference to that comment that you need a written lease.

Then just the terms and conditions of that rental agreement carry on on a month-to-month basis thereafter. Now, you can certainly renew it and extend it to another term, but you're not legally required to do so. So, yes, that lease does still apply.
