So this is tricky. I mean, it really is a matter of how you are going about your screening process and not showing that there is a specific discrimination against Section 8 applicants. That's what you want to avoid. And so let's say you have multiple people who are applying and you're reviewing each application and If the first tenant who is qualified and has completed the application and you have all of their information, the safest way to do it is to just approve that person, right? So let's say you got a Section 8 applicant. They gave you everything. You got the report. You have all the things you need. It's done. But you haven't given them a decision because you're hoping someone comes in who's not Section 8 and qualifies. That's where it could really kind of look bad in some cases. So I would say it's best to go in order of who has a full completed application and then screen them in that order and then decide in that order to be safe. But check with your attorney if you aren't sure or if you're in a situation where maybe it's a little like nuanced if they don't applied at the exact same time or something like that. So definitely check on that.
